THIRD PARTY RIGHTS (Grandparent Rights)

Third party rights, commonly known as Grandparent Rights, are not just for grandparents but may include step parents, aunts, uncles and other relatives or an adult that stands in loco parentis to a child or children. Third party rights cases are some of the most complex and fact intensive cases that exist in the area of domestic relations and child custody (legal decision-making). Obtaining legal representation or legal advice before pursuing third party rights is always best. We have referrals to attorneys who provide free phone consultations or can represent you in such cases, especially at trial. DOMESTICATING COURT ORDERS FROM OTHER STATES

Do you have a family court order from another state and want to register the order in Arizona so you may now or later ask the Arizona court to enforce or modify the order?

The other party has a right to request a hearing to object to the registering the order in Arizona. Separate documents are required if you are requesting an Arizona Court to enforce or modify the order.

Domestication – Register a Foreign (Out of State) Family Support Order - $200
We prepare your documents and file them with the Court.

Domestication – Register a Foreign (Out of State) Court Order for Custody, Legal Decision Making, Parenting Time or Visitation - $250
We prepare your documents and file them with the Court.

Maricopa County filing fees

There are no service costs for this process in Maricopa County. The Court is required to serve notice of your request to the other parties in the case.


DISCOVERY REQUESTS AND RESPONSES

Discovery Requests include:
  • Written Interrogatories (Uniform and Non-Uniform)
  • Production of Documents
  • Requests for Admission

We may assist with preparing discovery requests or responding to discovery requests. Court orders setting trial and evidentiary hearings typically have deadlines for these requests. Please carefully check your court order or consult with an attorney.

Discovery Request - $250
We prepare the request and serve the other party, or his or her counsel, if represented, by mail.

Discovery Responses - $300
We prepare the responses and serve the other party, or his or her counsel, if represented, by mail.

There is no court cost associated with this service.


SUBPOENAS

Do you need assistance with preparing, issuing and serving a subpoena?
We can help!

We can assist with both a Subpoena to Appear or a Subpoena Duces Tecum (subpoena to obtain documents)

Subpoena to Appear - $152
(includes $50 our services, $27 court issuance fee, $15 witness fee and $60 service of process for most areas)
We prepare the subpoena, issue the subpoena from the court and serve the subpoena.

Subpoena Duces Tecum – to obtain documents from a third party - $177
(includes $75 our services, $27 court issuance fee, $15 witness fee and $60 service of process for most areas)
We prepare the subpoena, notice of deposition, cover letter to custodian of records and affidavit of custodian of records, issue the subpoena from the court and serve the subpoena and accompanying documents.


STOP ORDERS OR MODIFY INCOME WITHHOLDING ORDERS

You may stop or modify a family support order by petition or agreement. Income Withholding Orders contain a termination date. Some employers still require a stop order from the Court. Orders of Assignment, the name of the garnishing document prior to the current name Income Withholding Orders, may not have a termination date. Please check with your HR Department for your employer to see if a stop order is required.

If you have more than one court ordered payment on your Income Withholding Order or Order of Assignment and one of those payments should be stopped pursuant to a court order or you have paid off your child support arrears, you may file to modify the Income Withholding Order. Please try contacting the court first to see if they will change it for you without requiring you to file a petition or agreement. We have received feedback from clients that the Court has allowed them to modify the Income Withholding Order by phone in Maricopa County.

Stop Income Withholding Order - $180
We prepare the documents, file the documents with the Court and coordinate service, if required. If the parties stop child support by Agreement, a filing fee is not required by the Court in Maricopa County.

Modify Income Withholding Orders - $180
We prepare the documents, file the documents with the Court and coordinate service, if required.

REQUEST FOR MEDIATION

Whether you want to request mediation or are required to request mediation before filing with the Court pursuant to your order, we can assist you.

Request for Mediation - $75
We prepare the request, file it with the Court, deliver it to the Court to set the mediation and coordinate service.
