Third party rights, commonly known as Grandparent Rights, are not just for grandparents but may include step parents, aunts, uncles and other relatives or an adult that stands in loco parentis to a child or children. Third party rights cases are some of the most complex and fact intensive cases that exist in the area of domestic relations and child custody (legal decision-making). Third Party Rights (Grandparent Rights) – Visitation/Custody – $350
We prepare your documents, file them with the Court and coordinate service of process. This is a start to finish price if the case is not contested.
If you can prove that both parents are abusive or unfit, you may file for Grandparent Rights for Custody. The court has the duty to decide the best interest of the child or children over parental rights.
When the parent with legal decision-making dies, the law automatically transfers legal decision-making to the living parent. If you believe this parent is not fit, you may file for Grandparent Rights for Custody with the Family Court.
You may also apply for Grandparent Rights Visitation to see your Grandchildren. It is best to consult with an attorney before proceeding. We refer to attorneys that provide free phone consultations. If a parent disagrees with you requesting Grandparent Rights Visitation, a trial and/or evidentiary hearing will be required. At the hearing, you will need to provide testimony and evidence to persuade the court that you have a meaningful and on-going relationship with your grandchildren and that it would be to the children’s determinate if the relationship is not allowed to continue.
Filing fees required by the court to process your documents vary depending on the County where you file your documents. If you qualify for a deferral or waiver of your filing fee, we can provide you with the required application and file it with the Court on your behalf.
